![]() Community Association Arbitration Arbitration is process under which parties to a dispute agree to present their dispute to a neutral third party. The third-party neutral presides over a formal hearing at which evidence is presented, arguments are made, and a legally binding decision is rendered. Arbitration is generally a voluntary process and it is often less expensive and time consuming than litigation, but it may not be available for all community association related disputes. Our attorneys pioneered the use of arbitration in construction defects litigation. Whenever possible, we encourage the use of alternative dispute resolution forums like arbitration to provide quicker, more economical processes to solve community association and construction defect disputes whenever the circumstances deem this mode of dispute resolution as the best approach. In accordance with the requirements of the Florida Condominium statute, we also actively assist our clients on a wide range of association topics and controversies in mandatory arbitration disputes coming before the Dept of Business and Professional Regulation.
