construction defects and real property litigation

From the inception of the firm, Hyman Spector & Mars, LLP has counted representation in real estate matters as one of the focal points of its practice. Such representation includes involvement in all aspects of real estate transactions on a state-wide basis. Our real estate department handles acquisitions, sales, leases, financing, foreclosures, land use and zoning matters for both residential and commercial properties. The firm is an unrestricted agent for Attorney's Title Insurance Fund, First American Title Insurance Company, and Old Republic Title.

Our clients include the full range of players in the real property arena, including developers, banks and the mortgage industry, and individuals in connection with all types of Florida real property transaction. We are experienced in rendering legal representation not only for real estate closings, but also for development planning, financing, and leasing for both residential and commercial properties.

Hyman Spector & Mars, LLP, has developed a specialization in the representation of financial institutions in connection with their conveyances of REO properties acquired through foreclosure. Such representation requires a sensitivity to the time and cost consideration of the asset manager in moving a property to liquidation while maintaining a commitment to deliver defect-free title at closing.

An area of specialization includes the emerging field of community association lending.  We are amongst the most experienced law firms providing legal services to both community association lenders and borrowers.

Our law firm has the depth of experience to perform virtually any legal services relating to the disposition and ownership of real property in the State of Florida.

We offer clients legal support in all aspects of real estate development, including analyzing and pursuing zoning and land-use approvals, structuring partnerships and other entities for the ownership of development projects, analyzing and resolving title insurance issues, obtaining and negotiating financing, negotiating and drafting purchase and sale agreements, construction contracts, architects' agreements, management agreements, and lease agency agreements, and creating and restructuring condominium and planned residential, office, retail and industrial park and mixed-used developments. The firm's lawyers regularly appear before federal, state and local governmental agencies on such matters as land use and environmental approvals and have developed good working relationships with these agencies in order to help our clients achieve the results that they seek.

We provide legal advice and service for:
